For Sale By Owner (FSBO) Escrow Services

A Clear Escrow Process for Your California FSBO Sale

For sale by owner escrow gives a buyer and seller a neutral party to hold funds and coordinate closing documents under written instructions. When a homeowner sells without a listing agent, the parties still need an organized process for the agreement, deposit, title requirements, financing and closing.

Guaranty Escrow helps California buyers and sellers coordinate the escrow portion of a FSBO transaction. Share your signed agreement, property location and intended closing date so our team can review the file and explain the next steps.

Escrow does not represent the buyer or seller, negotiate the price or replace legal advice. The parties remain responsible for their agreement, disclosures and other transaction obligations. Our residential escrow services explain the broader closing process.

Your FSBO Closing, Organized From the Start

1. Open With a Complete Agreement

Provide the signed purchase agreement and amendments, property address, buyer and seller information, proposed closing date and any lender or attorney contacts. Identify trusts or entity owners early so signing authority can be reviewed. Ask which opening documents and deposit arrangements apply to your file.

2. Coordinate Documents and Conditions

Track the title, payoff, lender, signing and funding items assigned to escrow. Buyers and sellers coordinate inspections, disclosures, contingencies and any legal review with their own advisers. Keep escrow informed of agreed changes and provide signed amendments when needed.

3. Review, Fund and Close

Review the estimated closing statement and resolve questions before the final steps. Confirm signing and funding arrangements directly with your escrow officer. Closing proceeds when the required instructions and conditions are satisfied; an intended closing date alone does not authorize release.

Prepare Before You Open FSBO Escrow

Start with the purchase agreement, all amendments, the property address and the legal names of everyone buying or selling. Identify the intended vesting, financing, earnest-money terms, agreed credits and proposed timeline. Share the contact information for your lender, attorney and other advisers.

If the seller is a trust or an entity, flag that early. Also identify any proposed repair holdback, occupancy after closing or other special arrangement before assuming it can be handled within the purchase escrow. Each request needs its own review.

Use our Homebuyer Escrow Roadmap, Seller Escrow Roadmap and Seller Escrow Checklist to organize your questions. Our property and supplemental tax guide explains why a later tax bill may be separate from closing.

FSBO Escrow FAQs

Can Guaranty Escrow handle a sale without a listing agent?

Yes. Guaranty Escrow can discuss a for sale by owner transaction and coordinate the escrow functions assigned by the accepted written instructions. Share the agreement and property details so the team can confirm the scope and opening requirements.

Escrow administers its accepted instructions and does not act as either party’s real estate agent or attorney. Buyers and sellers should obtain appropriate help preparing and reviewing their purchase agreement and required disclosures.

Provide the signed agreement and amendments, property information, the legal names of the parties, contact details, financing information and proposed closing date. The escrow officer will identify additional documents for the specific file.

The deposit is held and applied, released or returned under the agreement, accepted escrow instructions and applicable requirements. A deposit is not automatically payable to either party simply because someone asks for it or a proposed date passes.

A FSBO transaction may involve financing. Tell escrow about the lender early so loan documents, funding conditions and closing requirements can be coordinated. The lender determines loan eligibility and its own requirements.

Timing depends on the parties’ agreement, title and payoff matters, financing, signatures, funding and outstanding conditions. Ask the assigned officer to discuss the proposed timeline and responsibilities for your file.

Raise the issue promptly. Escrow follows its instructions and applicable requirements and does not decide the parties’ legal rights. A disputed release may require additional instructions or other appropriate resolution.

Request a transaction-specific quote. Property details, financing and the requested services affect the file. Review the scope and charges with the escrow team before opening.
