California Escrow Problems

When a Real Estate Transaction Doesn't Go as Planned

By Guaranty Escrow | California real estate resource

An escrow problem is a transaction issue that can delay closing, change the agreed next steps, or lead the parties to consider cancellation. A missed deadline, low appraisal, financing setback, or disagreement over repairs does not tell the whole story. The signed agreement, current instructions, and facts matter.

This guide helps California buyers, sellers, and agents organize the next conversation. Start with the issue below, then involve the professional responsible for it.

Escrow is a neutral administrator, not a judge of who breached a contract or who deserves a disputed deposit. This is general process information, not legal, tax, or financial advice.

Start With Three Questions

Before changing plans, separate the transaction issue from the paperwork escrow needs.

  • What does the signed agreement say?Locate the relevant contingency, deadline, amendment, or cancellation provision.
  • Who needs to respond?Your agent, lender, attorney, and escrow officer handle different parts of the transaction.
  • What written direction is missing?Ask your assigned escrow officer which instructions or documents are needed to administer the file.

Who Gets the Earnest Money When a Buyer Backs Out?

Earnest money does not automatically belong to the buyer or seller when a California buyer backs out. The purchase agreement, contingency status, reason for cancellation, and valid release authority matter. Escrow holds and administers the deposit; it does not decide a contested entitlement.

What Happens if a Buyer Backs Out After Removing Contingencies?

A California buyer who backs out after removing relevant contingencies may face a seller’s claim to the deposit or other contractual consequences. The outcome is not automatic: the agreement, specific removals, remaining rights, notices, and facts require professional review.

What Does Contingency Removal Mean in California?

Contingency removal means the buyer is proceeding without the protection of the particular contractual contingency being removed. In a California purchase, the actual agreement and signed documents determine what was removed, how it takes effect, and what remains.

What Happens to the Deposit When Escrow Is Canceled?

When a California escrow is canceled, the deposit is administered under appropriate release instructions or other valid authority. A cancellation notice does not necessarily authorize a refund or settle who is entitled to the money. Escrow remains neutral if the parties disagree.

What Happens When an Appraisal Comes in Low?

A low appraisal can affect the loan amount a lender is willing to provide and the buyer’s cash needed to close. It does not automatically reduce the purchase price, cancel the sale, or release the deposit. The lender’s requirements and the signed purchase agreement need separate review.

What Happens if Escrow Doesn’t Close on Time?

Missing a California escrow closing date does not by itself tell you whether the sale is canceled or which party may act next. Review the purchase agreement, outstanding closing requirements, notices, and any written extension with your transaction advisers.

Can You Extend Escrow in California?

Buyers and sellers can discuss extending a California escrow closing date, but an extension should be documented through the appropriate written agreement. Escrow cannot unilaterally extend the purchase contract, and a request is not the same as an accepted extension.

What Happens if the Buyer Can’t Get Financing?

If a California buyer cannot obtain financing, the transaction may need lender review, an agreed change, an extension, or cancellation. The loan contingency and its removal status are important, but a financing problem does not automatically cancel the agreement or authorize a deposit refund.

What Happens if Problems Are Found During the Final Walkthrough?

If a final walkthrough reveals a problem, document it and contact your real estate agent promptly before assuming the transaction will close unchanged. The purchase agreement, repair commitments, lender requirements, and any agreed written resolution determine the next steps.

Escrow Wire Fraud: How to Verify Wiring Instructions

Before sending escrow funds, obtain instructions through the established secure process and independently call the escrow office using a trusted number. Never rely on a phone number, link, or changed account detail supplied in the same unexpected message you are trying to verify.

The Right Question, the Right Professional

Your escrow officer

Ask about the file’s document status, deposited funds, and instructions needed for the next administrative step.

Your agent and lender

Your agent coordinates transaction discussions. Your lender addresses loan approval, appraisal requirements, and funding readiness.

Your attorney

Seek advice about cancellation rights, disputed deposits, alleged breach, or remedies. Escrow does not represent either side in a dispute.

The California Department of Real Estate’s escrow reference explains the escrow holder’s limited, neutral role.

Gather These Details Before You Call

  1. The signed agreement and changesInclude addenda, extensions, and contingency-removal documents.
  2. A simple timelineList the closing date, relevant deadlines, and when notices were received.
  3. The specific unresolved itemDescribe what is missing and who is working on it, without assuming who is at fault.
  4. Written instructions already deliveredAsk your assigned officer what is on file and what remains outstanding.

Concerned about wire instructions? Stop before sending funds. Verify instructions directly with your escrow officer using a previously established, trusted phone number. Do not rely on contact details in a suspicious message. If you already sent a suspected fraudulent wire, contact your bank immediately. Read our wire-transfer safety checklist.

California Escrow Problems: Common Questions

Does a missed closing date automatically cancel escrow?

Do not assume it does. The contract, any extensions, required notices, and circumstances need review. Ask your agent or attorney about rights and deadlines, and keep escrow informed of the resulting written instructions.

Does canceling escrow automatically return the deposit?

No automatic refund should be assumed. The contract and applicable release authority govern the process. A disagreement over entitlement needs resolution outside the escrow officer’s neutral administrative role.

Can an escrow officer tell me whether I should cancel?

An officer can explain the status of the escrow file and administrative requirements. Whether cancellation is legally permitted or financially appropriate is a question for your own qualified advisers.

Can I contact Guaranty Escrow about a file held elsewhere?

Contact the officer holding your existing escrow for file-specific information. Guaranty Escrow can discuss a new escrow inquiry, but cannot access another company’s file or direct its release of funds.
