What Does Contingency Removal Mean in California?

The Short Answer

By Guaranty Escrow | California real estate resource

Contingency removal means the buyer is proceeding without the protection of the particular contractual contingency being removed. In a California purchase, the actual agreement and signed documents determine what was removed, how it takes effect, and what remains.

Inspection, financing, appraisal, title, and other conditions may address different risks. Removing one does not necessarily remove every other condition, and it does not guarantee that the loan or closing will be completed. Read the document with your agent before signing; obtain legal advice if the consequences are unclear.

Three Different Milestones

  • Review the conditionObtain and discuss the reports, loan information, or other material covered by the contingency.
  • Make the contractual decisionThe buyer and advisers evaluate whether to remove, seek an agreed change, or take another permitted step.
  • Complete the closing requirementsLender approval, signatures, funds, title, and recording can still remain after removal.

Know Which Protection You Are Removing

Inspection or investigation

Review property information and the scope of reports. A completed inspection is not the same as a signed removal document.

Ask: Have the findings and unresolved issues been discussed?

Loan contingency

Confirm the lender’s actual status. A preapproval letter is not a promise that the loan will fund.

Ask: Which underwriting conditions remain?

Appraisal contingency

An appraisal-related protection can differ from a loan contingency. Review the value and any gap provisions in the agreement.

Ask: What happens under this contract if value is low?

Other contract conditions

Title, documents, or a sale-of-property condition may have separate terms. Check counters and addenda, not just the first page.

Ask: Which conditions are still in effect?

Removal Does Not Mean Every Risk Has Disappeared

These are hypothetical process examples, not client case studies or predictions of an outcome.

Only an inspection contingency is removed

The buyer signs a document addressing inspection. The team checks whether financing and appraisal protections remain rather than treating every contingency as removed.

The buyer has lender preapproval

The buyer considers removing the loan contingency while underwriting is unfinished. The lender explains remaining requirements; the buyer’s advisers discuss the contractual risk.

What Your Escrow Officer Can and Cannot Do

Confirm the file status

Identify documents, funds, and administrative requirements in the escrow file.

Follow valid instructions

Administer authorized funds and documents while remaining a neutral stakeholder.

Respect professional roles

Leave legal rights, loan decisions, technical inspections, and disputed claims with the appropriate advisers.

Escrow can confirm which removal documents and instructions are in its file and identify closing items it still needs. It does not select the buyer’s risk level, interpret disputed legal rights, or guarantee that a deposit will be returned if the buyer later withdraws.

Common Questions

Are all contingencies removed together?

Not necessarily. The removal document may address one or several conditions. Its wording and the agreement control.

Does a contingency disappear when its date passes?

Do not assume a universal rule. The contract may require particular notices or written steps; your adviser should review the actual terms.

Can escrow tell me it is safe to remove contingencies?

No. Escrow is a neutral administrator. The buyer should assess the decision with the relevant professionals and legal counsel when needed.

Can a buyer still back out after removal?

Possible rights and consequences depend on the contract and facts. Removing a relevant protection can increase risk to the deposit.

Does removal mean the house passed inspection?

No. It is a contractual decision, not a certification of condition or workmanship. Review the inspector’s actual findings.
